It’s OK Cupcake is a certified home bakery specializing in custom baked goods and desserts. By ordering from us or using our website, you agree to abide by these Terms and all applicable laws.

We reserve the right to update or change these Terms at any time. The date at the top reflects the most recent update. Continued use of our services after changes means you accept the new Terms.

2. Orders & Payment

• All orders are custom-made and must be paid in full (or according to the payment terms provided) before production begins.
• We accept payments through approved methods listed on our site or invoices.
• Prices are subject to change without notice due to ingredient costs, design complexity, or market fluctuations.
• Any added elements—such as premium fillings, edible images, toppers, or decorations—may incur an additional charge.
• Orders are not confirmed until payment is received and you receive written confirmation (email or message) from It’s OK Cupcake.

3. Cancellations, Refunds & Changes

• Cancellations: We understand plans can change, but because each order is custom, cancellations may not be eligible for full refunds. Please notify us as soon as possible.
• Refunds: Refunds are evaluated on a case-by-case basis. Once baking or design work has begun, refunds are generally not available.
• Changes: Design or flavor changes must be requested and confirmed at least 7 days before your scheduled pickup or delivery date.

4. Pickup & Delivery

• All pickup and delivery times must be confirmed in advance.
• Customers are responsible for inspecting their order at pickup or delivery. Once the order leaves our possession, we are not liable for damage due to handling, transport, or storage.
• If delivery is offered, a delivery fee may apply depending on distance and order size.

5. Allergies & Dietary Restrictions

While we take great care in preparation, please note that It’s OK Cupcake operates in a kitchen that may process common allergens, including nuts, dairy, eggs, gluten, and soy.

We cannot guarantee that any product is allergen-free. It is the customer’s responsibility to inform guests of any potential allergens.

6. Custom Designs & Creative Rights

• Custom designs and decorations are handmade and may vary slightly from reference images or sketches.
• All photos, designs, and creations by It’s OK Cupcake remain the intellectual property of the business and may be used for promotional or portfolio purposes unless otherwise requested in writing by the customer.

7. Website Use

• The content on our website (including text, images, logos, and designs) is owned by or licensed to It’s OK Cupcake and may not be copied, modified, or used without permission.
• You agree not to misuse our site, submit false information, or attempt to disrupt its functionality.

8. Limitation of Liability

It’s OK Cupcake is not responsible for:

• Allergic reactions, food sensitivities, or injuries resulting from consumption of our products.
• Damage, delays, or loss of items once they are picked up or delivered.
• Errors caused by incorrect information provided by the customer (e.g., address, date, flavor).

To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount paid for the order in question.

9. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes arising from these Terms or our services shall be handled within the appropriate courts of New York.
